TMMD ART Commercial License

1. Scope of this License

This Commercial License applies only when a buyer purchases or receives written approval for commercial use of a digital artwork from TMMD ART. A standard personal download license does not grant commercial rights unless commercial use is expressly stated in the order, invoice, agreement, or written authorization from TMMD ART.

2. Commercial Rights Granted

Subject to full payment and compliance with these terms, TMMD ART grants the license holder a non-exclusive, non-transferable, worldwide commercial license to use the purchased artwork for permitted commercial purposes.

3. Permitted Uses

• Print the artwork on canvas, posters, framed prints, decorative panels, and similar physical wall art products.
• Use the artwork for interior decoration in homes, offices, hotels, restaurants, studios, galleries, and commercial spaces.
• Use the artwork in marketing materials, websites, social media posts, product mockups, catalogs, digital ads, and promotional campaigns.
• Use the artwork on physical products such as apparel, mugs, notebooks, phone cases, packaging, greeting cards, calendars, and similar merchandise, only if the purchased commercial license level allows merchandising.
• Modify the size, crop, color balance, or layout of the artwork only as reasonably necessary for printing, display, or product placement.

4. Restrictions

• The artwork may not be resold, redistributed, sublicensed, shared, or offered as a standalone digital file.
• The artwork may not be uploaded to stock image websites, marketplaces, NFT platforms, AI training datasets, or digital asset libraries for resale or redistribution.
• The buyer may not claim authorship, copyright ownership, or exclusive ownership of the artwork unless a separate exclusive rights agreement is signed by TMMD ART.
• The artwork may not be used in illegal, defamatory, pornographic, hateful, deceptive, political propaganda, or harmful content.
• The artwork may not be used to create competing digital art packs, image bundles, prompt packs, NFT collections, or downloadable artwork collections.

5. Copyright and Intellectual Property

All copyright, intellectual property rights, source files, prompts, creative direction, and original production rights remain the exclusive property of TMMD ART unless a separate written copyright assignment is signed. Purchasing a commercial license grants usage rights, not copyright ownership.

6. Exclusive Rights

Exclusive rights are not included in this Commercial License. If exclusive use, copyright transfer, removal from future sale, or industry-specific exclusivity is required, the buyer must request and sign a separate written agreement with TMMD ART.

8. Liability

TMMD ART is not responsible for printing errors, color variations, third-party production issues, marketplace restrictions, or misuse of the artwork by the buyer or third parties. The buyer is responsible for verifying technical requirements before printing or manufacturing products.

9. Termination

TMMD ART may terminate this license if the buyer violates these terms. Upon termination, the buyer must stop using the artwork commercially and remove unauthorized digital or physical uses where reasonably possible.
